Villa Terms & Agreements
THIS TEMPORARY LODGING AGREEMENT (hereinafter called the Agreement) is by & between BuildHer LLC (a limited liability corporation.) located in Costa Rica (hereinafter called the “BHER") -AND- BuildHer Leadership Summit Attendee (hereinafter called the “Guest") for temporary lodging provided by Punto de Vista Luxury Services (hereinafter called “PDV") under the following terms & conditions:

NOTE 1: The Check-in / Check-out times above are set and cannot be changed by BHER, the PDV concierge, or even PDV management prior to check-in day.
NOTE 2: Guests who do not leave the premises by the checkout time or negotiated check-out time or date are subject to an additional night's rental fee, damages and legal action.
PROPERTY LOCATION
Manuel Antonio, Costa Rica. From just after the Los Altos Resort entrance turn right and go downhill. Turn left at the first gravel road to Playitas Beach. Villa La Isla is the 3rd property on the right with a tan wall, modern, angular black iron gates and bamboo elements. Villa Punto de Vista is the 5th property on the right with large black gates and a guard house.
PETS
Pets are not permitted on the premises unless they are professionally-trained service dogs and accompanied at all times by their owner. We will need proof of special service requirements to host a service animal on the premises.
COVID PREVENTATIVE MEASURES:
For your protection, the entire villa staff is fully vaccinated and practices strict hygiene and protocols upon your arrival to the property and throughout your stay. They will be wearing appropriate PPE (Including masks, face-shields) at all times in addition to frequent disinfection of their hands throughout the stay as well as constant disinfection and cleaning throughout the property of high-touch surfaces with approved cleaning/disinfecting products. Additionally, the property(ies) are sprayed/disinfected with ULV (ultra low volume) foggers, electrostatic sprayers and totally disinfected between stays using the most advanced equipment/products for your utmost safety. As a preventative measure to protect you and your guests, PDV staff & the local community, they kindly ask that you be sure that no one of your group members travel to Costa Rica with any kind of a cold or fever or exhibiting symptoms including but not limited to coughing, sneezing, runny nose, shortness of breath (a unique symptom to Coronavirus) etc. Anyone that arrives to Villa Punto de Vista exhibiting these symptoms will necessarily need to be either refused entry or quarantined on the premise pending notification of medical personnel so best they don’t travel to begin with.
If you or your guests have COVID-19, have been in contact with anyone that has COVID-19 in the last 15 days, have a temperature above 98.6F or exhibit cold-like symptoms you will not be allowed on the premises without a negative COVID-19 test result taken within the last 48 hours.
All Guests entering the PDV premises will be required to sign a COVID-19 Release of Responsibility Waiver / Agreement to Hygienic Protocols in addition to entry temperature checks and hand-sanitization requirements. It is also required that the guests maintain appropriate hygienic standards when off-property (e.g. mask wearing in public places, social distancing, frequent hand washing/disinfection). Additionally, it is required to report any symptoms, suspicion of symptoms and if it called to your attention that you have been in contact with a person infected with COVID you must immediately self-quarantine and inform PDV staff for next steps per Costa Rican health guideline and protocols.
Refusal to sign this waiver or follow these measures for safety will result in refusal to enter the premises or removal from the premises.
SMOKING IN ROOMS
All rooms and indoor spaces are NON-SMOKING. Guests are free to smoke on the roof terrace, open-air grand terrace and pool terrace areas.
SUBLETTING AND ASSIGNMENT
Guests shall not sublet the entire premises or any part of the premises, nor shall they assign this Lodging Agreement to anyone else.
UTILITIES
PDV will provide water, electric, propane, trash removal, internet, cable and satellite TV, International Calls (US & Canada). Guests are responsible for all international calls made during tenancy. Should users have their own Skype account, they may make Skype calls from the Villa's Media center.
Although the villa's elevator, utility infrastructure and municipal services such as water, electricity, gas, Internet, etc. are normally stable and the villa's have back-up systems for most of these utilities, this does not guarantee their perfect working order do to possible power outages, mechanical malfunction or acts of God, etc. Villa personnel will be on-staff for the event in order to mitigate any unforeseen problems should they happen to arise.
PDV is aware that a stable high-speed internet connection is important to most of our guests and they have taken a multitude of steps (technology-wise) to create as reliable an internet service possible. However, while infrequent, outages do occasionally occur for reasons out of their control and when they do this takes internet broadcasts of shows and movies as well as internet radio and Karaoke off-line.
LOCKBOXES
A laptop-sized lock box is provided for the convenience of the Guests in each room and a central safe is in the reception area for the guest's use as well. The Guests accept that no bond or warranty is provided for contents put into the safe, being their entire responsibility to protect and look after their belongings, furthermore they accept that the PDV and/or BHER has no responsibility for any loss. In addition and independent of the villa's lock boxes, valuables anywhere on the premises of the villas are the responsibility of the guests and PDV and/or BHER will not be held responsible or liable for lost or misplaced valuables of any kind.
CHILDREN
Children are strictly prohibited from BHER.
REFUSAL OF ENTRY TO THE VILLAS
PDV and/or BHER has the right to refuse entry to anyone they deem a threat to the villas and its occupants in any way.
OVERNIGHT GUESTS OF GUESTS
Guests of PDV and BHER are not allowed to bring other overnight guests to PDV not part of this agreement.
DAILY HOUSEKEEPING SERVICE
Linens/bath towels are included in the villas and daily maid service is included in the rental. PDV only permits specially designated colored beach towels to be taken from the villas and used as a part of the rental. Lost beach towels will result in a fee of $30.00 each.
LAUNDRY
Towels/bed linens are laundered off-site by our staff. There is a guest washer and dryer available at your convenience and available 24 hours a day*. As an additional option, Guests who wish to have clothing laundered or specialty laundering for them during their stay may do so via the independently owned laundry service offered. Turn-around time is between 24 and 36 hours depending on when the clothing is picked up from the villas. PDV and/or BEHR are not responsible for articles washed at the independently owned laundry service.
NOTE ON LAUNDRY: The Guests washer/dryer is for garments only that have been pre-washed of sand, mud, etc. Guests that cause damage to the washing/drying equipment by attempting to wash heavily soiled items or non-garments like shoes will be liable for any damages caused.
USE OF VILLA AMENITIES
Complementary villa amenities such as irons, ironing boards, steamers, hair dryers, etc. will be provided upon request on a first-come-first-serve basis. Use of these items is at the risk of the guests and PDV and/or BHER are not responsible for any damage to garments treated with these items.
A selection of DVD movies, Sony PlayStation 4 games and other items are for the complementary use of villa guests in the villas media rooms. The Estate Manager/Butler will provide a check-list of these items on day one of the rental for sign-off by a representative of the Guest. On the final day of the stay, the same list will be presented and a second sign-off by a representative of the Guest will ensure that all items are still present and in good working order. Any loss or damage to these items will be the responsibility of the Guest. Should the Guest not wish the responsibility for these items, they can be promptly returned to the villa's Estate Managers/Butlers.
PDV has Beach transportation available on call for their guests. Only the villa's butlers or company drivers will be permitted to drive during daylight hours and only between Villa 1 and Villa 2 and the beach. While free use of the buggy is included with the stay sometimes unforeseen mechanical issues arise and the buggy may need to be repaired. Therefore, the presence and use of the buggy cannot be guaranteed.
FALSIFIED RESERVATIONS
Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.
WRITTEN EXCEPTIONS
Any exceptions to the above-mentioned policies must be approved in writing in advance.
NATURAL HABITAT
Guests are not to feed or make physical contact with any natural wildlife at PDV. This requirement includes, but is not limited to: monkeys, tropical birds, sloths and other warm and cold blooded animals that inhibit the jungle adjacent to PDV. It's for the good of the animals as humans transmit certain viruses that the creates cannot defend themselves and can ultimately hurt or kill them.
FIREWORKS, FIRE LANTERNS AND OTHER INCENDIARY DEVICES
Due to the natural habitat surrounding the villas, neither fireworks nor sky/fire lanterns shall be ignited on PDV property nor on the road in front of the villas. PDV will not assist in permitting processes for incendiary devices of any kind. Reckless endangerment and therefore damage to PDV's property by the Guests thru the use of Fireworks, Fire Lanterns, Cigars and Cigarettes and/or any other incendiaries will be the financial responsibility of the Guest.
PARKING
Parking is limited to six (6) vehicles behind the villa 1 gate. Parking in front of the villa is also permitted where it does not interfere with traffic on the road. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the Guest. PDV and/or BHER are not responsible for lost or stolen items in vehicles parked inside or outside the villa.
ELEVATOR
The elevator in Villa 1 can accommodate no more than 6 persons at a time (and no more than 3 persons during certain maintenance conditions). The elevator in Villa 2 is primarily used for special circumstances and handicapped persons. It is not made for common transit and can accommodate no more than 2 passengers. If evidence is provided that the elevators are being abused by excessive loading at any given time, the Guest will be charged an elevator maintenance fee of $500.00 for an emergency servicing of the elevator to ensure no damage was done to the elevator system.
JACUZZI & ROOF DECK SAFTEY (VILLA 1)
Use at your own risk. PDV's maintenance person(s) sanitize and replenish chemicals in the jacuzzi prior to your arrival. DO NOT STAND ON THE BENCHES IN THE JACUZZI OR LEAN AGAINST THE GLASS IN THE JACUZZI FOR YOUR OWN SAFETY. ALSO, DESPITE THERE BEING A GLASS BARRIER, IT MUST BE CLEAR THAT TRESPASSING THE BARRIER FROM THE ROOF DECK TO THE VILLA ROOF IS PROHIBITED AND TRESPASSERS MAY BE ASKED TO LEAVE THE PREMISES. PDV and/or BHER are not responsible for any negligence by the Guest or their party leading to injury or death.
NOTE ON GLASS: No glasses or bottles shall be allowed on or in the Jacuzzi and should a glass item break in the Jacuzzi and the Jacuzzi need to be drained/cleaned a fee of $250.00 will be deducted from the Damage Deposit.
NOISE REGULATIONS (BOTH VILLAS)
As a general note, after 10pm (by Costa Rican Government Regulation) guests are required to lower sound levels considerably at Villa Punto de Vista. However, there are special restrictions as well as more lenient policies on sound levels as well and that is explained below:
THE ROOF DECK (VILLA 1)
This is a location of the villa with a direct noise corridor to an adjoining rental villa of a different owner. As noted above, after 10pm (by Costa Rican Government Regulation) Guest is required to lower sound levels considerably on the roof deck and not have gatherings involving loud voices or music.
THE DINING/EVENTS TERRACE (VILLA 1)
This is a location of the villa with a direct noise corridor to an adjoining rental villa. As noted above, after 10pm (by Costa Rican Government Regulation) Guest is required to lower sound levels considerably on the dining terrace and not have gatherings involving loud voices or music.
THE BALLROOM/LIVING ROOM & POOL AREA/LOUNGE (VILLA 1)
There will be no curfew on late-night/early morning gatherings and events within the Ballroom/Living Room space on the villa's ground floor. However, "reasonable" volume levels will be required by 2am. Also, the Ballroom/Living Room & Pool Area/Lounge feature a direct noise corridor to both the neighboring property as well as an adjoining rental villa of a different owner. After 10pm (by Costa Rican Government Regulation) the sliding glass doors of the Ballroom/Living Room will need to be closed and kept closed unless transitioning from the Ballroom/Living Room to the Pool Area/Lounge. Once outside, Guest is required to lower sound levels considerably in the Pool Area/Lounge and not have gatherings involving loud voices or music.
UPPER AND LOWER LIVING AREAS & POOL AREA/ (VILLA 2)
There will be no curfew on late-night/early morning gatherings and events within the Lower Living Area. However, "reasonable" volume levels will be required by 2am. Also, the Lower Living Area & Pool Area/Lounge features a direct noise corridor to both the neighboring property as well as an adjoining rental villa of a different owner. After 10pm (by Costa Rican Government Regulation) the sliding glass doors of the Lower Living Area will need to be closed and kept closed unless transitioning from the Lower Living Area to the Pool Area/Lounge. Once outside, Guest is required to lower sound levels considerably in the Pool Area/Lounge and not have gatherings involving loud voices or music. Only conversational volumes of speech will be permitted in the Pool Area/Lounge past 10pm. The same 10pm noise rule applies to the Upper Living Area (which is open air) and the open air terrace on the lower level.
FINANCIAL AND OTHER PENALTIES REGARDING NOISE
The Costa Rican government is permitted to apply fines or even shut-down businesses that do not comply with their policies on noise. Therefore, PDV and/or BHER has the right to charge up to $1,000.00 per noise violation as described above and even remove your party from the premises should warnings not result in compliance with these Costa Rica government and villa noise regulations.
POOLS AND KIDS POOL (BOTH VILLAS)
Use at your own risk. PDV's maintenance person(s) will sanitize and treat the pools prior to your arrival. PDV and/or BHER is not responsible for any negligence by the Guest or their party leading to injury or death.
NOTE ON GLASS: No glasses or bottles shall be allowed on or in the pools or kids pool and, should a glass item break in the pool/kids pool and these water elements need to be drained/cleaned, a fee of $500.00 will be deducted from the Damage Deposit.
WASTE TREATMENT
The environmentally friendly, closed-system treatment plant is very large and very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than a responsible amount of toilet paper. No feminine or contraceptive products should be flushed at any time. If it is found that feminine or contraceptive products have been flushed and clog the septic system, you could be charged damages of up to $300.00.
THE ROAD
We highly recommend using private transportation to get to and from the villa as there is very little need while in Manuel Antonio. If you do bring a personal or rented vehicle note the road is owned and maintained by the local Municipality of Aguirre and is only maintained periodically. While PDV maintenance persons maintain the road as best as possible without the use of heavy equipment, the road is often not fit for use by non-4x4 vehicles. There will be no refund due to road conditions.
AGREEMENT OF NON-COMPLIANCE
Guest expressly accepts and agrees that any guest who violates any of the terms of this Agreement shall be immediately denied occupancy and shall remedy any damages or other expenses which are caused by the Guest and/or their party.
ILLEGAL DRUGS
Guest agrees that if they are found using illegal drugs or allows others to use illegal drugs on the premises, they will be immediately denied continued occupancy at PDV and/or BHER and are subject to expulsion off the premises with no refund for the remaining dates.
LAWFUL USE
Guest and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use PDV and/or BHER for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises.
CANCELLATION POLICY
We understand that life happens, but due to the nature of this exclusive event, all sales are final, and no refunds will be issued under any circumstances. This includes cancellations due to personal reasons, scheduling conflicts, illness, or travel restrictions.
However, you may transfer your ticket to another attendee if you are unable to attend. Name changes and transfers are permitted up to 30 days prior to the event start date. It is the responsibility of the original ticket holder to coordinate the transfer and notify our team of the replacement.
By registering for the BuildHer Retreat, you acknowledge and agree to this policy.
PASSPORTS
The Guest understands that all travelers must have a passport valid for at least 6 months from the trip return date as well as four (4) blank pages for all international travel.
HOLD HARMLESS
Guest agrees to save PDVs, BHERs, PDV's beneficiaries and agents, BHER’s beneficiaries and agents, and both of their respective successors and assigns them harmless and indemnified from all injury, loss, claims, or damage to any person at PDV and/or BHER occasioned by an act or omission of Guest or anyone entering, occupying, or visiting the premises by, through, or under the Guest.
APPLICABLE LAW
PDV is a Costa Rican company and PDV estate is located in Costa Rica. BHER is an American company located in Twin Falls, Idaho. This agreement is governed by and interpreted in accordance with the laws of Costa Rica and the State of Idaho as they apply.
SEVERABILITY
Every provision of this Agreement is intended to be severable. If any term or provision hereof is illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity of the remainder of this Agreement.
TERMINATION
Either party may terminate this agreement in the event of a violation of the obligations contained herein, by the other party in the manner and as provided by law.
ENFORCEABILITY
Should any provision of this agreement be deemed unenforceable by a court of competent jurisdiction, the remaining provisions shall remain intact and enforceable.
EXECUTION BY E-MAIL
If executed by e-mail, this Agreement shall become binding and enforceable. Scanned, digital signatures are acceptable evidence of a binding agreement between BHER, PDV, and the Guest.
ELECTRONIC SIGNATURES
While we wish you to sign this agreement as a formality, due to the nature of this being an electronic contract, it should be noted that the recorded action of this document being opened (viewed) by the Guest indicates an understanding of all terms of this agreement. If after the viewing of this document occurs by the Guest and a deposit is made to BHER, that payment implies acceptance of the terms found in this agreement independent of this agreement being signed or not.
PLEASE READ CAREFULLY:
The PDV and/or BHER are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. PDV and/or BHER are not responsible for the loss of personal belongings or valuables of the Guest. By signing this contract, it is agreed that the Guest is expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the villas.
